Sale & Use
These terms apply to christiancherry.com, merch.christiancherry.com and orders placed through the Christian Cherry merch shop.
1. Seller and contact
The seller is Christian Cherry, an independent online trader based in Cyprus. Customer support: christian@christiancherry.com or christiancherry.com/support.
2. Products and ordering
Product photos are mockups and colours can vary by screen and production batch. Check the description and size guide before buying. Most merch is printed on demand by our production partner. Your order is an offer to buy; a contract is formed when payment is accepted and the order is confirmed. We may cancel and refund an order that cannot be fulfilled, appears fraudulent or contains an obvious price or description error.
3. Prices and payment
Prices and available delivery charges are shown before payment. Stripe processes payment securely; we do not receive full card details. Your bank may apply its own currency conversion or other charges. Any taxes collected at checkout are shown before you pay.
4. Production, delivery and tracking
Delivery estimates are estimates rather than guaranteed dates. Production usually begins shortly after a successful order, so contact support immediately if something is wrong. Delivery can be affected by carrier, customs, address or events outside reasonable control. Tracking is sent when the carrier makes it available.
5. EU/EEA withdrawal right
If you are an EU/EEA consumer, you normally have 14 days after receiving goods to withdraw without giving a reason. Email support with an unambiguous statement before the deadline. You may use this wording:
“I withdraw from my contract for [item], ordered on [date], received on [date]. Name: [name]. Delivery address: [address]. Order number: [number].”
Return goods without undue delay and no later than 14 days after telling us. Unless the item is faulty, incorrect or we agree otherwise, you pay direct return postage. We refund the product price and the least expensive standard outbound delivery option within 14 days of your notice, but may wait until the goods arrive or you provide proof of return. You may be responsible for reduced value caused by handling beyond what is needed to inspect the item.
The withdrawal right does not apply where a legal exception applies, including goods made to your specifications or clearly personalised. A standard print-on-demand design is not treated as personalised merely because it was produced after ordering.
6. Faulty, damaged or incorrect items
Contact support promptly with the order number and clear photos. Your mandatory consumer rights remain intact. EU consumers have a minimum two-year legal guarantee for goods that are faulty or do not match their description. Depending on the circumstances, the remedy may be repair, replacement, price reduction or refund. Do not send a return before support supplies the correct return instructions.
7. Refunds and cancellations
Approved refunds go to the original payment method. Bank processing times vary. If production has not started, we will try to cancel an order; this does not limit any mandatory withdrawal or consumer rights. Refunding through Stripe does not automatically stop fulfilment, so contact support before cancelling an order in progress.
8. Website, music and game
The site, music, artwork, game, designs, text and branding are protected by intellectual-property rights. You may use them for personal, non-commercial enjoyment. Do not copy, resell, scrape, interfere with, reverse engineer or misuse the site or its content except where law allows. External services and links have their own terms.
9. Liability
Nothing here excludes liability that cannot legally be excluded, or limits mandatory consumer rights. Subject to that, we are not responsible for indirect or unforeseeable losses, business losses, third-party services, or delays beyond reasonable control.
10. Law and disputes
Cyprus law governs these terms, while consumers keep any mandatory protections of their country of residence. Please contact support first so we can try to resolve a problem directly. You may also use the consumer-protection and court procedures available under applicable law.
